DCS Chess is a product brand of Universe Connect.
This End User License Agreement ("License") governs the use of CZUBATRONIC 2400 ("Software"). By installing, activating or using the Software, the user accepts the terms of this License.
CZUBATRONIC 2400 is proprietary software developed and published under the DCS Chess brand.
All rights, title and intellectual-property rights in the original CZUBATRONIC 2400 software, source and object code, graphical assets, interface elements, documentation, product presentation, proprietary data and other original components remain with Arne Baillière, trading as Universe Connect, or with the respective rights holders where third-party material is identified.
The purchase of CZUBATRONIC 2400 grants a right to use the Software. It does not constitute a sale or transfer of the Software's intellectual-property rights, source code, design assets, proprietary data or underlying technology.
CZUBATRONIC 2400 is not open-source or public-domain software.
Separately identified chess engines, libraries, fonts, artwork, firmware interfaces and other third-party components remain the property of their respective rights holders and are subject to their applicable rights and licence terms.
Subject to payment of the applicable licence fee and compliance with this License, the purchaser is granted a limited, non-exclusive right to install and use CZUBATRONIC 2400 in accordance with the licence or edition purchased.
The licence is intended for use by the purchaser.
Where a particular product edition specifies a limit on users, installations or devices, use of the Software is restricted to that limit.
Unless expressly stated otherwise at the time of purchase, the licence permits personal use of CZUBATRONIC 2400 by the purchaser.
The licence does not grant any right to distribute the Software, operate it as part of a commercial service, incorporate it into another product, or make it available to third parties.
Separate commercial, institutional, OEM, distribution or integration rights require prior written permission from Universe Connect.
A backup copy may be retained where permitted or required by applicable law.
Except where expressly permitted by this License or by mandatory applicable law, the user may not:
a. copy, reproduce, distribute, publish, upload, mirror or otherwise make the Software available to third parties;
b. sell, resell, sublicense, rent, lease, lend, commercially exploit, bundle, repackage or rebrand the Software;
c. distribute an altered, unofficial, patched, modified or repackaged version of CZUBATRONIC 2400;
d. modify, adapt, translate or create derivative versions of the Software for distribution;
e. reverse engineer, decompile, disassemble or otherwise attempt to derive source code, internal implementation details, proprietary formats, algorithms or proprietary data from the Software;
f. extract, reuse, redistribute or incorporate proprietary CZUBATRONIC 2400 graphics, interface assets, documentation, databases, configuration data or other protected components into another product;
g. remove, conceal or alter copyright notices, licence information, digital signatures, attribution notices, product identification or other rights-management information;
h. circumvent, disable, interfere with or attempt to defeat licence controls, authentication mechanisms, activation mechanisms or technical protection measures;
i. use licence keys, activation credentials, entitlements or other access credentials belonging to another purchaser, or knowingly make such credentials available to another person;
j. present an unauthorised version of the Software as an official CZUBATRONIC 2400, DCS Chess or Universe Connect product;
k. use the Software, its assets or proprietary components to create or distribute a product falsely presented as affiliated with, derived from, authorised by or endorsed by DCS Chess or Universe Connect.
Nothing in this section restricts rights that cannot legally be excluded, including statutory rights relating to backup copies, observation or testing of software, correction of errors or interoperability where applicable.
Only Arne Baillière, trading as Universe Connect, or a party expressly authorised by him in writing, may publish or distribute official builds of CZUBATRONIC 2400.
The availability of a downloadable installer, trial version, update, demonstration version or other release does not grant permission to mirror, redistribute, publicly archive or republish that release.
No third party may distribute an official or unofficial build of CZUBATRONIC 2400 without prior written permission.
No third party may package CZUBATRONIC 2400 together with other software, hardware or services for redistribution without prior written permission.
DCS Chess is the product brand under which CZUBATRONIC 2400 and related chess software may be developed, published and marketed by Universe Connect.
Use of the DCS Chess name, CZUBATRONIC name, associated product names, logos, artwork or other branding in a manner that suggests official affiliation, endorsement or authorship is not permitted without prior written authorisation.
This License does not grant any trademark, branding or merchandising rights.
CZUBATRONIC 2400 may support, communicate with or make use of separately developed chess engines, electronic chess boards, emulators, hardware interfaces, communication libraries, drivers or other third-party software.
Ownership or licensing of CZUBATRONIC 2400 does not imply ownership of those third-party products.
Where third-party components are supplied with the Software, their applicable copyright notices and licence terms remain in force and take precedence with respect to those components.
Software, ROM images, firmware, chess engines, databases, game files or other material obtained separately by the user remain subject to the rights and licences of their respective owners.
CZUBATRONIC 2400 does not grant the user any right to possess, copy, distribute or use third-party material for which the user does not otherwise possess the necessary rights.
Support for or technical compatibility with a third-party product does not imply endorsement, partnership or affiliation with its manufacturer or rights holder.
CZUBATRONIC 2400 may permit users to connect, configure or use compatible third-party chess engines, files or other resources.
The user is responsible for ensuring that the user has the legal right to possess and use such material.
Universe Connect does not acquire ownership of user-supplied software or data merely because it is used with CZUBATRONIC 2400.
Universe Connect is not responsible for the licensing status, legality, reliability or behaviour of third-party material installed or supplied by the user.
Universe Connect may provide maintenance releases, corrections, compatibility updates, security updates, feature updates or new versions of CZUBATRONIC 2400.
Unless expressly included in the purchased licence, the purchase of one version does not automatically create an entitlement to future major versions, additional products, optional modules, separately sold extensions or new editions.
Updates required under mandatory applicable law remain unaffected by this provision.
Features, supported hardware, supported engines, system requirements and external integrations may change between product versions.
Universe Connect may discontinue support for obsolete operating systems, hardware interfaces, third-party software or technical environments where continued compatibility is no longer reasonably maintainable.
CZUBATRONIC 2400 is intended for the operating systems and hardware environments stated in the applicable product documentation.
Compatibility with operating-system versions, drivers, hardware devices, external chess engines, emulators or other third-party products not expressly identified as supported is not guaranteed.
Compatibility with a third-party product may change as a result of updates made by that third party.
Users are responsible for ensuring that their system meets the published technical requirements.
Official releases of CZUBATRONIC 2400 may be digitally signed by or on behalf of Universe Connect.
A valid digital signature may be used to verify the publisher and confirm that the signed executable has not been modified after signing.
Removal, replacement or manipulation of an official digital signature or other integrity information does not create an authorised version of the Software.
Only software distributed through an official DCS Chess or Universe Connect distribution channel, or through an expressly authorised distributor, should be regarded as an official release.
CZUBATRONIC 2400 is complex software and may contain software defects, hardware-specific incompatibilities or limitations.
No voluntary guarantee of completely uninterrupted, error-free or universally compatible operation is given unless expressly stated in writing.
This provision does not limit statutory rights.
Where the purchaser is a consumer, all mandatory rights relating to digital products, contractual conformity, defects, updates, remedies and consumer protection under applicable law remain unaffected.
Any commercial guarantee expressly provided with a particular edition of the Software applies in addition to statutory rights and does not replace them.
Liability is governed by applicable law.
Nothing in this License excludes or limits liability where exclusion or limitation is prohibited by law.
This includes, in particular, liability arising from intentional misconduct, gross negligence, injury to life, body or health, fraudulent concealment of defects, expressly assumed guarantees or mandatory product-liability legislation.
Mandatory statutory consumer rights remain unaffected.
Where liability may legally be limited, Universe Connect is not responsible for losses caused solely by unsupported third-party software, unsupported hardware, user modifications, external drivers, unofficial builds, unauthorised modifications or use contrary to the published system requirements.
The right to use the Software may terminate if the user materially breaches this License and fails to remedy that breach where applicable law requires an opportunity to remedy it.
Material breaches may include unauthorised redistribution, commercial exploitation, rebranding, circumvention of licence controls or distribution of modified builds.
Following termination, the user must cease any use or distribution for which the user no longer holds a valid right and must delete copies that the user is no longer legally entitled to retain.
Termination does not affect rights or remedies arising from an earlier infringement or breach.
Any transfer of a licence is subject to applicable law and to the terms under which the licence was originally supplied.
Where applicable law gives the purchaser a right to transfer a lawfully acquired licence, nothing in this License is intended to remove that mandatory right.
A person transferring a licence may not retain and continue using copies where doing so would result in simultaneous unauthorised use.
Licence keys, accounts or activation credentials may not be separately sold or transferred independently of the corresponding lawful licence where such separation would create unauthorised additional copies or users.
Failure by the rights holder to enforce a provision of this License in a particular case does not constitute a general waiver of that provision or of any other right.
If any provision of this License is found to be invalid, unenforceable or ineffective, the remaining provisions remain unaffected to the extent permitted by applicable law.
Mandatory statutory provisions apply in place of any ineffective contractual provision where required.
This License is governed by the laws of the Federal Republic of Germany.
Where the user is a consumer, this choice of law does not deprive the user of mandatory protections granted by the law of the country in which the user has their habitual residence where such protections apply.
All rights not expressly granted under this License are reserved.
No permission is granted by implication to reproduce, redistribute, commercialise, sublicense, republish, repackage or incorporate protected CZUBATRONIC 2400 components into another product.
